Landlords advised to get their house in order
A new housing law that comes into effect in early April that could impact on some landlords in the District was discussed at Sevenoaks District Council's Cabinet meeting last week (Thursday 16 February).
Under the Housing Act 2004, properties of three or more storeys that are occupied by five people or more making up two or more households will need a ‘Houses in Multiple Occupation’ licence issued by Sevenoaks District Council.
Failure to have a licence in place could result in a fine of up to £20,000. A tenant living in a property that should have a licence, but does not, can claim back up to 12 months rent during the unlicensed period.
The Council can also reclaim any housing benefit that has been paid during the time the property was without a licence.
Cllr Carol Clark, the Council Cabinet member with responsibility for housing, says: "Although this change in legislation will affect very few landlords in the District, I would advise anyone who is unsure how the new legislation will impact on them to contact us, as once this law is introduced in April any affected landlords without the relevant licence in place run the risk of incurring a big fine."
Landlords have to complete an application form, available from Sevenoaks District Council, and pay a fee. The Council then inspects the property and carries out checks into the background of the landlord.
